[NI0152] Charles' marriage to Sophia Slater in 1834 caused the bride to be ostracized by her family who considered themselves to be members of the "gentry", and had brought Sophia up to be "a lady". The Slaters connections with the "gentry" were more genealogical than real and at the time of Sophia's birth, they were conducting a business at The Star Inn, in Market Square, Petworth, which today still stands as a Hotel, but is now known as The Star.

[NI0152] In 1838 Charles, Sophia and two girls, Sophia and Mary Emma, secured selection by Mr. H. Western, South Australia's agent or Colonization Commissioner, as suitable emigrants for the new Colony of South Australia, as assisted migrants. They left South Downs (London) on 12 September 1838 in the Barque "Prince George" under the command of Captain J. Young. The ship was described as follows:

[NI0152] About 1000 miles west of the Australian coast the second daughter, Mary Emma was burnt to death on board and was buried at sea on 8 Dec 1838.

[NI0152] The "Prince George" arrived at Holdfast Bay, Adelaide at 11pm on 26 December 1838 and the passengers were taken to the Receiving Depot, Emigrant Square in the West Parklands, there to stay until they found employment.

[NI0152] Shipping Register Reference 38/29�B. in the Adelaide Archives shows that application for assisted passage card to come to South Australia as 20 April 1838; lists -- Charles 38 years, Carpenter and his wife Sophia, 28 years, of North Chichester.
Children:- Females 2� and 7 months.

[NI0152] The Fogdens appear to have been socially not at ease in the new Colony, which at the time of their arrival, was only two years old. Mrs. Fogden insisted on being treated as a lady, while her husband, whenever the occasion arose, liked to dress in a white suit and white hat. He was socially ambitious, intent on taking advantage of the new Colony, to raise his station in life, but, his 16 years in the Colony were marked with continual hard-ship and failing health, ending in his premature death at 45 years.

[NI0152] Soon after arriving, he took his family to live at The Tiers, the name given to the step-like and densely wooded sloped south east of the settlement of Adelaide. These forests provided good employment for a carpenter, but they were notorious for their rough life and as a hiding place for escaped convicts from the Eastern States.

[NI0152] In 1840, Richard was born, the first child of the family to be born an Australian, while they were still living in the Hills.

[NI0152] In 1844, Charles tried to break free from this harsh environment and migrated down to the Adelaide Plains, but prior to this owned property at Hahndorf, where their second son, Charles was born in 1842. Charles set himself up as a Master Carpenter after moving to Payneham Village, taking contracts and employing labour, and it was while they were living here that Ann was born (1845). Early in 1846, the family moving into the centre of the City of Adelaide and Charles took out a General Licence for the Gawler Arms Hotel in Morphett Street. This was relinquished after only three months.

[NI0152] When the next child, Eleanor, was born they were living in South Terrace, Adelaide and Charles was once again the Gentleman Carpenter (1847). All these undertakings proved to be financial failures and Charles was again forced to return to the land, this time they settled near Nairne. Frances was born here (1849) and Charles is listed as owning 90 acres near Nairne in 1850. Again, he failed, and by 1853 had moved to Langhorne's Creek, then known as Langhorne's Bridge.

[NI0152] Edwin Thomas was born before the family left Nairne. Charles once again took up his profession as a Master Carpenter at Langhorne's Creek.

[NI0152] In August 1853, history repeated itself, when Sophia, the eldest child, married a handsome, hard-drinking, coloured man - naturally, she was ostracized by her family, the same as her mother before her. Samuel Johns, Sophia's husband, was a well-educated man and was a Veterinary Surgeon as well as being a Station Manager.

[NI0152] In February 1854, Charles saw a brief period of glory, when he uncovered the bush-ranger Joshua Lazarus, who was sheltering in the hills.

[NI0152] Charles Fogden's health and financial situation were sinking fast. Not long after coming to South Australia he developed a serious heart condition and this had gradually become progressively worse. He petitioned the Government for permission to cut wood and quarry stone on public land but was refused. In 1854, he declared himself bankrupt and unable to meet his debts. Eight months later, he died, on New Years Day 1855, presumably from a heart attack. He was only 45 years old.

[NI0152] For some time the family struggled on at Langhorne's Creek. The two boys, Richard and Charles, then only in their teens at the time of their father's death, worked to keep the family from starving. About 1860, they all moved to a cottage at Hugh Wellington's sheep station, near Wellington, where the two boys and Ann found work.

[NI0152] In 1862, the eldest boy, Richard, married Jane Wylie at Plainfield, Wellington. Also in 1862, the Fogdens hit the headlines in a much publicized court case of forgery. Late in 1862, Samuel Johns was gaoled for forgery, mainly on the evidence of his mother-in-law and her family. The local residents then petitioned for the case to be re-opened and during the enquiry, Mrs. Fogden admitted planting the evidence on Samuel Johns, presumably to be rid of him. Johns was release from prison but the Crown Solicitor decided not to pursue the case against Mrs. Fogden. Lucky lady!

[NI0152] On 11 December 1865, Mrs Fogden bought land on the River Bremer near Langhorne's Creek, but the family evidently did not stay very long, as Richard and Charles took up land on the Blyth Plains shortly thereafter, while Thomas took over the Black Eagle Hotel at Sevenhills.

[NI0152] In 1866, Frances Fogden married Robert Elliot of Blyth Plains and Mrs. Fogden went to live with them.

[NI0152] In 1876, Sophia John's husband, Samuel was drowned in the River Murray in mysterious circumstances - he actually fell off the back of the paddle-steamer while drunk. Mrs Fogden immediately sent her sons in a wagon to bring Sophia up to Blyth Plains, where Sophia settled, actually at Clare and she became a midwife, which she practiced for the remainder of her life. She is buried at Clare Cemetery, and Samuel is buried at Mannum, SA.

[NI0152] The Fogdens were a very clannish family, but Ann broke away soon after she married Duncan McInnes in 1863. Duncan had been an employee at Hugh Wellington's sheet station near Wellington and they migrated to the Gippsland area in Victoria to take up land there.

[NI0152] In the early 1880's the clan made another move. Tempted by the run of good seasons they took up land in the marginal region beyond Orroroo. The move ruined them and finally the family had to scatter. The first victim was Thomas, who had gone further north to take over the Royal Victoria Hotel at Beltana. In 1880, he became bankrupt and in order to preserve his savings, committed forgery and was sent to gaol for his trouble.

[NI0152] Richard moved back to the Langhorne Creek area and finally settled on Murray Road, Belvidere, near Strathalbyn, SA.

[NI0152] After the death of Mrs. Sophia Fogden (1891), the Elliots moved to Western Australia. Only Charles was left to battle the harsh environment. Of course, Angus William had taken up land in the region so Charles was not alone.

[NI0152] Thomas, on hearing of the Silver Strike in Broken Hill had gone to try his hand there, but not for long as he died from pleurisy and is buried at Sevenhills, SA.

[NI0152] After Mrs. Sophia Fogden passed away her sister came out from England to find the outcast but she was too late. All the evidence points to the Fogden family as being gentle people who worked very hard. Several of the sons, like their father, suffered from premature deaths due to vascular complaints.

[NI1758] In 1851, lived at Wood Farm, Headington, Oxfordshire, UK. Wood Farm was south of Old Road and east of the Slade (the road leading from Headington to Cowley). The White family had the farm for many years after the Pethers, but in the 1960s the farmhouse was demolished, and a new estate built on the farmland.

[NI1758] The property was farmed jointly with his brother Henry, despite Henry living at Bartlemas Farm until his death. Gardner's Directory of 1852 lists 'Pether, Richard and Henry, Wood Farm" and a handbill of 1857 shows that part of Peat Moor on the edge of Headington Quarry was let out to R & H Pether. The people of Headington Quarry fought hard to prevent Richard Pether from enclosing the Open Magdalens, a stretch of open common and wood on which Quarry, together with its neighbours, claimed collective
rights.

[NI1758] Richard lived at Wood Farm until about 1891. In directories from 1895 onwards Richard Pether is listed as Private Resident of Old Headington, living in Unity House (a fine house that still bears that name in Larkin's Lane). He must have died there in 1902/3, because in 1903 and 1904 directories list just the "Misses Pether" there (presumably the Annie and Elizabeth who kept house for him at Wood Farm at the time of the 1891 census). By 1904, the Pethers seem to have vanished from Headington.
